PTS made a decision on 6 July 2004 regarding obligations for the ‘fixed networks interconnection market’.
Teliasonera must satisfy every reasonable request for interconnection with other
stakeholders who so request (which for the respective market includes origination, termination or transit services). Other operators only have obligations in the ‘termination market’. For all operators, this obligation means that they must implement those measures that are necessary for users to be able to communicate with each other or to gain access to services that are provided in the networks and also measures that facilitate both the connection of networks or ancillary installations and conclusion of agreements on the exchange of traffic and associated services. This obligation entails a duty to both conclude contracts and to ensure that the traffic really functions.
TeliaSonera, Tele2 and Telenor shall upon request establish a direct connection to an operator who so wishes, and they should also satisfy every reasonable request for access to a network termination point. In order to establish direct connection, it is necessary to have network capacity between the operators, so-called ‘operator access’. TeliaSonera is obligated to provide upon request such network capacity between network termination points in Teliasonera’s networks and a physical network termination point in the requesting operator’s network.
In those cases where another operator requests, all of the operators are obligated to conclude direct billing agreements. TeliaSonera is also obligated to apply cascade settlement when it provides transit services for an operator and the operator for which the transit service is provided does not have any direct billing agreement with the terminating operator.
TeliaSonera must provide termination, origination and transit services together with direct connections, operator access and cascade settlement at a cost-orientated price. The cost-orientated price should be calculated in accordance with the LRIC method, except regarding operator access where the pricing should be conducted in accordance with an FDC model based on historical costs. The price regulation that other operators should apply regarding access is ‘fair and reasonable pricing’, which is defined as a price equal to the cost-orientated price according to the LRIC model.
All operators should offer the services on non discriminating terms, i.e. the access should be offered on equal terms under equal circumstances and with equal quality to all parties requesting the service.
All operators have an obligation to publish information that is of importance for negotiating an agreement. In addition to that TeliaSonera should also publish a reference offer.
